This information defines and regulates the use conditions, the disclaimers and the obligations which the users of the Web page published under the domain name www.prepacking.es assume and undertake to respect.
Definitions
“Page”, domain www.prepacking.es that is at the disposal of Internet Users.
“User”, private individual or legal entity that uses or browses the page.
“Content”, pages that form the complete domain www.prepacking.es, integrating the information and services that PREPACKING puts at the disposal of Internet Users. They contain the messages, texts, photographs, graphs, icons, logos, technology, links, textures, drawings, sound and/or image files, recordings, software, appearance, graphic design and source codes and, in general, any type of material contained in the page.
“Web”, technical word that describes the system of access to information via Internet, which is set up by means of pages designed with HTML language or similar, and programming mechanisms such as Java, JavaScript, PHP, or others, etc. These pages, designed and published under an Internet domain name, are the result of the information that the holder puts at the disposal of Internet Users.
“Hyperlink”, technique by which a User can browse different pages of the Web, or the Internet, with a simple click on the text, icon, button or indicative containing the link.
“Cookies”, technical mean for the “traceability” and follow up of the browsing on Web sites. They are small text files written on the computer of the User. This method has implications on privacy; therefore, PREPACKING will warn promptly and reliably of their use when they are implemented on the Page.
Use Conditions
The simple and mere use of the Page grants the condition of User of the Page, whether to legal entities or private individuals, and mandatorily implies the complete and full acceptance, with no reserves of any and all clauses and general conditions included in this Legal Warning. If the User is not in agreement with the use clauses and conditions of this Legal Warning, he will not use the Page.
This Legal Warning is subject to changes and updates, the version published by PREPACKING can be different each time the User gains access to the Portal. Therefore, the User must read the Legal Warning in each and all occasions in which he gains access to the Page.
Through the Page, PREPACKING provides the Users with the access and use of several contents published by means of the Internet by PREPACKING or authorised third parties.
The User is obliged and undertakes to use the Page and Contents in accordance with the legislation in force, the Legal Warning, and any other warning or instruction of which he is made aware, whether by means of this legal warning or in any other place within the contents forming the Page, and with the rules of coexistence, morale and generally accepted good habits.
To that regard, the User is obliged and undertakes NOT to use any of the Contents with illegal purposes or effects, forbidden in the Legal Warning or by the legislation in force, damaging the rights and interests of third parties, or that can in any way damage, render useless, surcharge, deteriorate or prevent the normal use of the Contents, computer equipment or the documents, files and all types of contents stored in any computer equipment of its own or contracted by PREPACKING, from other Users or from any Internet User (hardware and software).
The User is obliged and undertakes not to transmit, spread or put at the disposal of third parties any type of material contained in the Page, such as information, texts, data, content, messages, graphs, drawings, sound and/or image files, photographs, recordings, software, logotypes, brands, icons, technology, photographs, software, links, graphic design and source codes, or any other material to which it has access in its capacity as User of the Page; this list is without limitation.
Furthermore, in accordance with all the above, the User will not be able:
– To reproduce, copy, distribute, put at the disposal or in any other way publically communicate, transform or modify the Contents, unless it has the written and explicit authorisation of PREPACKING, which is the holder of the corresponding rights, or unless it is legally permitted.
– To suppress, handle or in any way alter the copyright and the rest of identification data of the reserve of rights of PREPACKING or its holders, of the footprints and/or digital object identifiers, or of any other technical means established for recognition.
The User must abstain from obtaining and even from trying to obtain the Contents using to do so means or procedures different from those that, depending on the cases, have been put to its disposal to that regard or have been indicated to that regard in the Web pages where we find the Contents or, in general, or from those habitually used on the Internet to that regard, provided that they do not imply a risk of damaging or rendering useless the Page and/or the Contents.
Intellectual Property
All brands, trade names or distinctive signs of any type which appear on the Page are property of PREPACKING or, where applicable, of third parties who have authorised their use; it cannot be understood that the use or access to the Portal and/or to the Contents attributes the User any right on the mentioned brands, trade names and/or distinctive signs, and it cannot be understood that any operation rights that exist or can exist on the mentioned Contents have been assigned to the User.
Also, the Contents are intellectual property of PREPACKING, or where applicable of third parties; therefore, the Intellectual Property Rights are ownership of PREPACKING or of third parties who have authorised their use, to whom the exclusive exercise of the operation rights of the same in any form corresponds and, in special, the rights of reproduction, distribution, public communication and transformation.
The unauthorised use of the information contained in this Web, and the damage to the Intellectual or Industrial Property Rights of PREPACKING or of Third Parties, included in the Page, who have assigned contents, will give rise to the legally established liabilities.
Hyperlinks
People who intend to establish hyperlinks between their Web Page and the Page will observe and comply with the following conditions:
– No prior authorisation will be necessary when the Hyperlink only allows access to the Homepage, but it cannot be reproduced in any way. Any other form of Hyperlink will require the express and unequivocal authorisation in writing by PREPACKING.
– No “frames” will be created with the Web Pages or about the Web Pages of PREPACKING.
– No false, inexact or offensive representations or indications will be made about PREPACKING, its executives, employees or co-operators, or about people listed in the Page for any reason, or about the Users of the Pages, or about the Supplied Contents.
– There will be no statement and we should not be lead to suppose that PREPACKING has authorised the Hyperlink, or that it has supervised or assumed in any way the Contents offered or put at the disposal of the Web Page in which the Hyperlink is established.
– The Web Page in which the Hyperlink is established will only contain what is strictly necessary to identify the destination of the Hyperlink.
– The Web Page in which the Hyperlink is established will not contain information or contents that are illegal, contrary to morale and generally accepted good habits and to the public order, and it will also not have content contrary to any right of third parties.
Cookies
Cookies are the technical means for the “traceability” and monitoring of browsing in Web Sites. They are small text files which are written on the computer of the User. This method has implications on privacy; therefore, PREPACKING informs that it will be able to use cookies with the purpose to elaborate statistics about the use of the web site, and to identify the PC of the User, allowing recognising it on its next visits. In all cases, the User can configure its browser in order not to allow the use of cookies on visits to the web site.
Availability of the Page
PREPACKING does not guarantee the inexistence of interruptions or mistakes in the access to the Page, to its Contents, or that they are updated, although it will use its best endeavours in order to, where applicable, avoid them, remedy them or update them. Therefore, PREPACKING is not liable for the damages of any type produced to the User whose causes are the failures or disconnections on telecommunications networks producing the suspension, cancellation or interruption of the service of the Portal during the rendering of the same or previously.
PREPACKING excludes, with the exceptions contemplated in the legislation in force, any liability for the damages of all natures that may be due to the lack of availability, continuity or quality of the operation of the Page and the Contents, and to the non compliance with the utility outlook which the Users may have attributed to the Page and to the Contents.
The function of the Hyperlinks which appear in this Web is exclusively that of informing the User about the existence of other Webs which contain information about the matter. Those hyperlinks do not constitute any suggestion or recommendation.
PREPACKING is not liable for the contents of those linked pages, for the operation or utility of the Hyperlinks or for the result of those links, and does not guarantee the absence of viruses or other elements on the same, which may cause alterations in the computer system (hardware and software), the user documents or files, excluding any liability for damages of any type caused to the User for this reason.
The access to the Page does not imply the obligation of PREPACKING to control the absence of viruses, worms or any other harmful computer element. The availability of suitable tools for the detection and disinfection of harmful computer programmes corresponds, in all cases, to the User; therefore, PREPACKING is not liable for the possible safety errors that may be produced during the rendering of the service of the Page, or for the possible damages that can be caused to the computer system of the user, or of third parties (hardware and software), the files or documents stored in the same, as a consequence of the presence of a virus in the computer of the user used for the connection to the services and contents of the Web, for a bad operation of the browser or for the use of non updated versions of the same.
Quality of the Page
Given the dynamic and changing environment of the information and services supplied by means of the Page, PREPACKING uses its best endeavours, but does not guarantee the complete veracity, accuracy, reliability, utility and/or updated nature of the Contents.
The information contained in the Pages making up this Portal has only an informative, advisory, divulgative and advertising nature. In no case does it offer or has the nature of a binding or contractual commitment.
Disclaimer
PREPACKING excludes any liability for the decisions that the User may make based on this information, and for the possible typographic errors that the documents and graphs of the Page may contain. The information is subject to possible periodical changes with no prior warning of their content due to extension, improvement, correction or updating of the Contents.

All notices and communications by PREPACKING to the User made by any means will be considered effective for all purposes.
Availability of Contents
The rendering of the service of the Page and of the Contents has, in principle, an indefinite duration. However, PREPACKING is authorised to terminate or suspend the rendering of the service of the Page and/or of any of the Contents at any time. When it is reasonably possible, PREPACKING will previously warn about the termination or suspension of the Page.
Personal Data Protection
PREPACKING is aware of the importance of the privacy of personal data, and that it is why it has implemented a policy of data treatment oriented to provide the maximum safety in the use and collection of the same, guaranteeing the compliance with the regulations in force about the matter and configuring that policy as one of the main pillars in the operation lines of the entity.
When browsing the web www.prepacking.es, the request of personal data is possible through the different forms established to that regard. Those data will form part of the pertinent files depending on the determined and specific purpose which motivates the collection of the same.
Thus, the particular information of each data treatment will be provided together with each web form; the entity responsible for the file will be common to all of them: PREPACKING SERVICIOS, S.L. with address in C/ Pelaya 21, puerta B, 28110 Algete (Madrid), together with the place and way of exercise of the rights of access, rectification, cancellation and opposition, which must be formalised by means of a written communication to the address indicated below, including a copy of the National Identity Card or equivalent identification document.
If you provide your data by an e-mail message, the same will form part of a file whose purpose will be the management of the request or comment made, with the application of the rest of the points indicated in the previous paragraph.
Furthermore, the general contracting conditions of the services of PREPACKING contain the characteristics and nature of the treatment of the data that will be developed by the same if you contract any of them.
On the other hand, PREPACKING has implemented the technical and organisational measures necessary to avoid the loss, bad use, alteration, unauthorised access and theft of Personal Data that the interested parties may provide as a consequence of the access to the different sections of the website www.prepacking.es, applying the safety measures contemplated in Royal Decree 1720/2007, 21st December, approving the Regulation which develops Organic Law 15/1999, 13th December, on Personal Data Protection.
Jurisdiction
For any matters on the interpretation, application and compliance with this Legal Warning, and on claims that can arise from its use, all intervening parties submit to the Courts and Tribunals of ALCOBENDAS, expressly waiving any other jurisdiction that may correspond to them.
Governing Law
The Legal Warning is governed by Spanish law. In case of dispute between the translation to other languages of the Spanish version of this text and the Spanish version, this last one will prevail.
